Confused by the Smoke: Medical Marijuana

Although medical and recreational marijuana has been legalized in California, it remains illegal under federal law - What rights do employees have and what are an employer's obligations?  This session will provide an overview of how marijuana laws impact the workplace, including an employer's ability to test or discipline employees for marijuana use, and its obligations to allow marijuana use as an accommodaton for disabilities or medical condition. The session will also address employment policies involving marijuana.


Ryan H. Nell is an employment attorney responsible for representing California employers statewide in both counseling and comprehensive litigation support.  With the ever-changing landscape of California and federal employment law, Ryan prides himself on assisting clients in staying ahead of the curve in an effort to avoid legal trouble before it arises.  He has extensive experience representing clients in harassment, retaliation, and discrimination matters, as well as large-scale wage and hour lawsuits.

Ryan speaks regularly on a wide range of topics aimed at assisting California employers in the avoidance of legal trouble before it arises, and his work in the field has led to his recognition as a Rising Star by San Diego Super Lawyers.

Ryan graduated magna cum laude from the University of Illinois College of Law. While in law school, Ryan was a member of the Federal Civil Rights Clinic, representing clients in federal claims from inception through trial.  He also served as an extern for the Los Angeles Superior Court and Illinois Office of the State’s Attorney, gaining extensive experience litigating claims on behalf of local governmental agencies.  Before law school, Ryan attended the University of Southern California, where he was recognized as a Presidential Scholar and earned a degree in Political Science.

Dr. David W. Carter is an executive trainer, professional speaker, and best-selling author. An experienced educator for several institutions, businesses, and non-profit organizations, he has also served in the United States Air Force as a combat engineer, as a Kansas police officer specializing in narcotics enforcement, and as an education technician for the National Park Service. Dr. Carter was certified by the Drug Enforcement Administration (DEA) in Highway Interdiction for High Intensity Drug Trafficking Areas (HIDTA) and he currently serves as a volunteer for the San Bernardino County Gangs and Drugs Taskforce.

Dr. Carter has given two TEDx talks about leadership: The Lesser Seat (2015) and How Old Are You? (2016) and he holds a doctorate in Higher Education and Organizational Change from Benedictine University (summa cum laude). His previous work has appeared on multiple news and media outlets and, most recently, C-SPAN’s Book TV, which highlighted his 2013 bestseller, Mayday over Wichita.

Dr. Carter serves as Claremont Lincoln University’s Vice President for Academic Affairs.
